GERSTLACHER, Johann Andreas. Tractatus medico-legalis de stupro in usum eorum qui jurisprudentiae et medicinae operam dant praecipue vero eorum qui in foro versantur... Erlangen: Wolfgang Walther, 1772.
4to (208 × 168 mm), pp. [iv], 80. Woodcut ornaments. Slight worming from p. 40, confined to a single area (c. 20 mm square) affecting a few letters on each page but not obscuring sense. Contemporary grey boards, slightly rubbed and soiled. A good copy.
First edition of this legal and medical treatise on the concepts and definitions of rape and of sexual intercourse in general. Gerstlacher was a physician, but the work is clearly aimed at the legal profession. He cites Carpzov, Brunemann, and Kress as well as St Augustine in exploring complex issues such as sex within and outside marriage, ages of maturity, the status of sex without male ejaculation and prostitution.
Worldcat lists the BL and National Library of Medicine copies only outside continental Europe.
