8vo (194 × 116 mm.), pp. [vi], x, 445, [3]. Title printed in red and black within double ruled border. Occasional light browning or staining, but generally quite clean. Contemporary panelled calf, sympathetically rebacked and recornered, preserving original spine, new label to style. Gilt supralibros of the Faculty of Procurators in Glasgow, early ownership inscription 'Jo: Russells [?] Sept 4th 1714 ps £3:12'. A good copy.
First and only edition. A treatise on the responsibilities of guardians in Scots law, as derived from the Institutes of Justinian, from Roman law in general and from feudal custom. It relates mainly to the treatment of children's rights in society, but there are also provisions for the guardianship of the insane and the immoral (notably prostitutes). As in other areas of Scottish law Jews and Roman Catholics are expressly debarred from the office of 'tutor' or guardian.
